Depends. On my last contract it says no but when contacted the private landlord and gave him my notice and offered last months rent being taken from my deposit, he was an absolute angel and let me have it that way.

But then again, he knew that if there was one person in the house to not to take liberties and leave premises in decent condition it would be me. I don't think that would have worked if I had been with an agency.

it is, within the 'right of estate' principle automatically granted with a housing contract. at the end of the day, you just need to stand your ground and tell him you're keeping the money. the worst he can do is ask you to leave, but what would be the point? you might not get much of a reference tho.
