Samples from movies and other commercial tunes are illegal unless first cleared by the movie studio or record label that owns the copyright on the original material. That applies to any length of sample, even if it's only one second.

This question pops up so many times.
Unless you have a massive commercial release that makes shed loads of money, you'll generally go un-noticed by the copyright holders. Saying that though, your record could acheive massive success, get caught and youlose all your profits and get a hefty bill from the courts.
Fatboy Slim didn't clear the strings sample on Right Here/Right Now and lost a lot of money.
Basically it doesn't matter how long the sample is, you're still copying someone elses work. If you're a none profiting organisation then you do have clearance to take the sample.
