i want to use samples , the ones i have in mind are from movies and vocals from some hip hop tracks.

what is the law regarding this , im not entirely sure

do i need to split the samples into 6seconds each or what ? will be mainly for hard trance breakdowns that i want to create.

Help!

Samples from movies and other commercial tunes are illegal unless first cleared by the movie studio or record label that owns the copyright on the original material. That applies to any length of sample, even if it's only one second.

unless the track is actually gonna be released i wouldnt worry about it

and in most cases even if it gets released theres not much chance of getting sued or anything as the amount of money that a hard trance tune would make would be minimal to the amount it would cost to take you to court and theres not really much chance of a hip hop artists actually ever hearing the track so i wouldnt worry to much

but yes in normal cases all samples must be cleared with the original artists

you can get round this by getting Someone to perform the vocals for you... the same as if you wanted to sample a track... if you played it yourself you wont have to clear the sample...

However,

You will have to credit the original composer/writer, as it's work that you have recreated from their originals

This question pops up so many times.

Unless you have a massive commercial release that makes shed loads of money, you'll generally go un-noticed by the copyright holders. Saying that though, your record could acheive massive success, get caught and youlose all your profits and get a hefty bill from the courts.

Fatboy Slim didn't clear the strings sample on Right Here/Right Now and lost a lot of money.

Basically it doesn't matter how long the sample is, you're still copying someone elses work. If you're a none profiting organisation then you do have clearance to take the sample.

Like everyone else has said, unless its going to be heard by thousands of people, they're not going to know. But if it is going to be released on vinyl, it could just be a white label. I think you can sample up to about 5 secounds legally anyways.

Good advice putting it out on white label though.
